Drive Well School of Motoring Terms and Conditions

Drive Well School of Motoring (DSM) is a business that provides driving instructor training and pupils to driving instructors. Your instructor is a self -employed franchisee of DSM and as such DSM has no responsibility or liability to you.
The contract for driving tuition is solely between you and your instructor. You and your instructor are responsible for agreeing all matters relating to the timing and location of individual lessons. You must notify your instructor of any matters which affect your ability or entitlement to have driving tuition. DSM retains the right to transfer pupils to another instructor.


Instructors provide professional practical driving instruction to the Driving Vehicle Standards Agency (DVSA) syllabus. All pupils have a student record card to show progress made which will be completed and retained by the instructor at the end of each lesson.

Payments and booking lessons

The level of a learners experience will be determined by the instructor and any introductory offer is at the instructor’s discretion. If a pupil cancels a block booking or intensive course, any lessons already taken will be chargeable at the full hourly rate before a refund is considered. Any refund will be subject to a £10 administration fee.

Payment must be made in full at the start of the lesson. All lessons must be completed within 3 months of booking or payments will be lost. At the discretion of the instructor, pick up and drop off points are flexible provided they are within a reasonable distance of the instructor’s usual working area.

If you require your lesson to start or end at a location other than your normal or previously agreed location you must give your instructor a minimum of 4 hours’ notice. No unreasonable request will be refused.

At the discretion of your instructor you may be accompanied on your lesson by a friend or relative. However, you must first gain permission in advance from your instructor. Anyone accompanying you must not interfere with the lesson in anyway, and if they do they will be told to leave the car as soon as it can be safely stopped and parked, regardless of geographical location.


When you book your lesson you are doing so at a time chosen by you, and your instructor agrees to keep that arranged time to accommodate you. For this reason, if you wish to cancel or change your lesson, a full 48 hours’ notice must be given or you will be charged for the reserved lesson. With 48 hours’ notice an instructor can offer the time you booked to another pupil. Regardless of reason of cancellation this will be enforced.

Cancellations must be made directly between you and your instructor. If you do not give at least 48 hours’ notice of cancellation, your instructor will be entitled to charge for the lesson(s) concerned.

Text messages sent by you will be deemed to have been received when a reply is made by your instructor. An instructor must also give you 48 hours’ notice of cancelling a lesson, or a free lesson must be given, unless the lesson is cancelled for one of the reasons below.

A 50% non-refundable deposit will be required before booking of an intensive course, with the balance due on the first day of training.


While every care will be taken to ensure pupils receive lessons at the requested time, all bookings are made on the understanding that instructors are not responsible for the postponement of lessons due to traffic conditions, adverse weather conditions, mechanical breakdown of equipment or any other r cause outside their control. Instructors will do everything possible to ensure that your lessons start and finish on time, but reserve the right to cancel, postpone or change lesson lengths and start/finish times under certain circumstances (e.g. dangerous weather conditions).

If your instructor is late they will endeavour to add this time to the next lesson. If after arriving at your nominated pick up point for your lesson there is no reply at the address in question, the instructor will wait approximately 10 minutes. If after 10 minutes, you have not made contact or they are unable to reach you, the lesson will be abandoned and you will be required to pay the standard cancelation policy fees for the lesson(s) in question.

If a pupil is required to wear glasses or contact lenses whilst driving and he/she fails to wear them on a driving lesson or test, then the lesson will be cancelled with full charge. Pupils must advise their instructor of any medication or prescription drugs they are taking that may affect their ability to drive safely before taking any lesson booked.

The instructor reserves the right to cancel a lesson at short notice if it is suspected that the pupil may be unfit due to the effects of alcohol, drugs (prescribed or otherwise) or any other condition that would cause his/her driving to be dangerous or illegal. In such circumstances the lesson fee will still be charged.


The instructor will at all times behave in a professional manner towards pupils. Instructors and pupils must treat each other with respect and consideration. The instructor will try to avoid physical contact with a pupil except in an emergency or in the normal course of greeting.

Whilst reserving the right not to give tuition the instructor will not act in any way which contravenes legislation on discrimination.


All DSM instructors will be registered with the Driving Vehicle Standards Agency (DVSA), and agree to be bound by the DVSA code of conduct for driving instructors. DSM will do everything possible to ensure pupils have the same instructor and type of car for all lessons and driving test, but do not guarantee this.


All fees include pupil cover whilst driving the tuition vehicle, provided the pupil is licensed to drive, and is accompanied by an instructor or on a driving test with an approved DVSA Examiner(s). Pupils are not allowed to drive the vehicle unaccompanied.

Driving test

Pupils must not book a driving test until their instructor advises them to do so, and before booking they must first confirm the test time with their instructor to ensure the tuition vehicle and instructor are available at that time. Instructors reserve the right to withhold the training vehicle if in their opinion you do not reach the required standard or your driving is potentially or actually dangerous.

If you insist on taking the test against instructor advice it will be your responsibility to arrange a suitable vehicle. DSM and its instructors cannot be held responsible for driving test appointments postponed or cancelled by the DVSA.

If on the day of your test it is cancelled by the DVSA, the instructor will still charge for test time you have booked in instructors cannot be held responsible for late arrival for test, missing test appointments or any vehicle failure that occurs during the test, and are not liable for consequential loss.

All bulbs/lights etc. will be checked prior to the test. Candidates may request a second check in their presence.


DSM and your instructor are not liable to you for any loss or damage caused, or for any property left in the training vehicle.


Complaints must be made in first place to the instructor concerned. If the matter cannot be resolved with the instructor, you may contact DSM by phone during normal office hours within 21 days of the incident you are complaining about. DSM will endeavour to resolve the situation within 5 days of hearing from you. We reserve the right to change or alter any of the terms and conditions without notice, but will endeavour to inform you of any changes as soon as possible.
